I’m sorry I’ve been absent from the forums of late- been dealing with my house situation since the VCAT hearing of our current nightmare residence whereby my housemate and I found out 4 hours later on the 25/11 that our new rental property had been cancelled due to the ‘owner’s having a change of circumstances’. It turns out that our current property manager had contacted our new property manager (our new rental) somehow and had found out our new address despite the lawyers blanking out the lease agreement at the VCAT hearing on the 25/11 and had said stuff that was wrong about us which is why they wanted to cancel the new lease agreement. The problem with that was we had signed the new lease agreements on the 13/11 and the new landlords had also signed it which made the contract legally binding and this was made fully aware by the VCAT member last Wednesday morning when it was heard as a urgent case. We had lawyers to handle the case which we did win despite our new property manager telling us that they were going to challenge the case as we had lied to them about our current address (the current nightmare property manager made some derogatory comments at our inspection on the 21/10 to my housemate including things like we were never going to get a property and we would be homeless which she would ensure was going to happen. Anyway, we won that case on Wednesday and picked the keys up yesterday (Sat) with the lawyers sending the new property manager some instructions about handing them over as ordered by VCAT or face harsh legal penalties and having the police involved if she didn’t. As it is, there is a VCAT hearing on Tuesday for our new property, however, our lawyers have ensured the case will get thrown out as the new property manager has referred to the wrong sections of the residential act and there is nothing the new property manager can do. As it is, the new property manager hired a person to represent them on Wednesday but the VCAT member tore them apart with what they were saying and it was all over in 10 minutes with a win to us, thanks to our lawyers and the fact that the new property manager had obtained information without our consent and that the evidence was inadmissible because of this.

 

The current property manager is being a total nightmare with her winning our bond on the 25/11 by saying we had trashed the place and the landlord needed to remove us ASAP as we were continuing to damage the house. We have to be out by the 13/12 with us arranging removalists on Wednesday to move us to our new country location. We are also in the process of getting an intervention order against our current property manager for what she is doing to both of us both emotionally and psychologically as well as physically with her constant emails and the fact she was able to track us down to our new rental and actually sabotage us from getting it (didn’t work). She even arranged a storage for us as our lawyers told her we didn’t have a property to go to on Friday which again, goes totally against her role as a property manager. The landlord apparently wants the house back as he is moving in due to having mental health issues with his family members (a total lie) and if he doesn’t get the place back on the 14/12, he’ll be homeless ( he’s got 3 other rental properties and this is the current line the property manager is saying). Let’s just say, both the landlord and she are going to find themselves in lots of legal troubles in the forms of compensation, discrimination and human rights issues with what they have done to us as this little issue isn’t over according to the lawyers involved in our case against them. 

Things have been quite stressful for me and my housemate, especially my housemate as she’s been handling all of this current stuff and doing an excellent job of it, even forgoing medical treatment to make sure we have a house to go to and dealing with the legal challenges and issues. I’ve been trying to focus my energy on being productive in the form of knitting beanies for Ambulance Victoria and knitting a kids jumper. (see photo of the baby beanie). In addition to this, I’ve been watching Gossip Girl at night on the 9Now app and have been watching the cricket on TV as well. Both my housemate and I have snapped at each other due to the stress - we’re cool now and back to normal - and things have been rough with my sister and I (she’s been emotionally abusive towards me) but I’ve gotten through it and that’s the main thing. I’ve learnt that I’m a lot stronger than I ever thought I was and I can get through things with the right people on my side helping me. Life is tough but so am I!

So sorry to hear @Judi9877 .

Been through a toxic divorce, and the legal system can be really sucky.  Sending love and praying for a successful outcome for you.  Baby steps.  Breathe.

Hello @StuF how are you going today? Just been doing everything power generators for summer, might be able to get financing options through the company itself instead of taking out a loan through Plenti. I'm buying a power generator in case of blackouts so I have a steady supply of power. Might go for a walk later. I hope you've had a good day

I worked this morning (driver is back! yay!) which was fine then had a haircut (No 2 all over please lol) and then my GP cut what was probably a wart off my forehead and sent it for biopsy. So, mixed  kinda day. Quiet evening ahead.

I hope you get your generator organised asap

When do you get the results back from biopsy? Youre back at work again. Let the other dude do the driving @StuF!!! Its a convenient way to sidestep things lol. I've been for a walk and the hydrogen water is boosting my exercise.  I still feel slowed down on these meds. Just looking at my budget and doing my sums this afternoon. Get paid my DSP Wednesday
